1.Acceptance of these terms
These Terms & Conditions ("Terms") govern your access to and use of deposithive.com (the "Site"), operated by DepositHive ("DepositHive," "we," "us"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years old and able to form a binding contract to use the Site or submit an account request.
2.What the Site is, and what it is not
The Site provides information about DepositHive's security deposit services and allows you to request an account. Descriptions on the Site, including descriptions of accounts, interest, deadline tracking, and documentation, are general summaries. The services provided to you are governed by the separate written agreements and disclosures presented at account opening, which control over anything on the Site.
Submitting the account request form is an inquiry only. It does not open an account, create a customer relationship, move any funds, or obligate either you or DepositHive to proceed.
DepositHive is a financial technology company. It is not a bank, trust company, law firm, accounting firm, or investment adviser. Nothing on the Site is an offer to provide banking services in any jurisdiction where such an offer would be unlawful.
3.No legal, tax, or financial advice
Content on the Site, including the summaries of state security deposit rules in Schedule A, is provided for general education only. It is not legal, tax, accounting, or financial advice, and it is not a substitute for advice from a qualified professional who knows your situation. Landlord-tenant law varies by state, city, building type, and lease, and it changes. You are responsible for confirming the requirements that apply to you before relying on any summary published on the Site.
4.Accuracy of information; illustrative figures
We work to keep the Site accurate, but we do not warrant that any content is complete, current, or error-free. Statutory summaries may not reflect recent changes in law or local ordinances. Interest figures shown on the Site, including any annual percentage yield, are illustrative, variable, and subject to change, and do not constitute a promise of any particular return. Where state or local law directs deposit interest to tenants, that interest is paid to tenants.
5.Account requests and communications
When you submit the account request form, you represent that the information you provide is accurate and that you are authorized to provide it. You consent to DepositHive contacting you at the email address you provide regarding your request. We may decline any account request in our discretion, including where we are unable to serve your state.
6.Acceptable use
You agree not to:
- Use the Site in violation of any applicable law;
- Submit false, misleading, or infringing information through the form or by email;
- Interfere with the operation or security of the Site, including by probing, scanning, or testing vulnerabilities without authorization;
- Scrape, harvest, or collect information from the Site by automated means for commercial purposes without our written consent;
- Misrepresent your affiliation with any person or entity.
7.Intellectual property
The Site and its contents, including text, design, graphics, the DepositHive name, and the hexagon seal mark, are owned by DepositHive or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view and use the Site for your personal or internal business evaluation of our services. No other rights are granted. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent, except as permitted by law.
8.Third-party services and links
The Site relies on third-party services, including Formspree for form processing, Google Fonts for typefaces, and the unpkg content delivery network for one script, and it may link to third-party websites. Those services and sites are governed by their own terms and privacy policies. We are not responsible for third-party content, services, or practices.
9.Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
10.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DEPOSITHIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY TO THE SITE ONLY; THE SERVICES ARE GOVERNED BY THEIR OWN AGREEMENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11.Indemnification
You agree to indemnify and hold harmless DepositHive and its officers, directors, employees, and agents from claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site, except to the extent caused by our own negligence or willful misconduct.
12.Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Site that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing in this section limits any non-waivable rights you have under the consumer protection laws of your state of residence.
13.Changes, termination, and general provisions
Changes. We may revise these Terms at any time by posting an updated version on this page with a revised "Last updated" date. Material changes will be noted prominently. Continued use of the Site after changes take effect constitutes acceptance.
Termination. We may suspend or terminate access to the Site at any time. Sections that by their nature should survive termination, including Sections 7 through 12, survive.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and DepositHive regarding the Site.
